1. 條款之接受

歡迎使用「光之點名簿」(以下簡稱「本服務」)。本服務由 Mesker @ 鳳凰(以下簡稱「我們」)開發並提供,服務網址為 https://xivrc.com。

當你登入、存取或以任何方式使用本服務時,即表示你已閱讀、瞭解並同意受本服務條款(以下簡稱「本條款」)及隱私權政策之全部內容拘束。若你不同意本條款之任何部分,請勿使用本服務。

2. 名詞定義

• 使用者：登入並使用本服務之個人。
• 團隊：使用者於本服務中建立或加入之固定隊／群組單位。
• 團隊管理者(隊長)：於特定團隊中具有管理權限之使用者。
• 平台管理者：具有全站管理權限之人員(由營運者指定)。
• 使用者內容：使用者於本服務中提供或產生之資料,例如角色名稱、伺服器、出席回報、排班資訊等。

3. 服務內容

本服務是一套為《Final Fantasy XIV》(以下簡稱「FFXIV」)玩家固定隊設計的出席與場次管理工具,功能包括但不限於:建立團隊、排定場次、投票回報出席狀態(出席／不出席／部分出席)、檢視成團狀態與出席統計等。

本服務為免費提供之個人專案,並依「現況」(as-is)提供,我們不保證其功能永久存在、無中斷或完全無錯誤(詳見第 11 條)。

4. 使用資格

使用本服務,你必須:

1. 年滿 13 歲(或你所在地要求使用 Discord 之最低年齡,以較高者為準)。若你未滿法定成年年齡,應在法定代理人同意下使用。
2. 擁有有效之 Discord 帳號,並遵守 Discord 服務條款。
3. 遵守 Square Enix 就 FFXIV 所訂之相關使用規範。

5. 帳號與登入

1. 本服務僅透過 Discord OAuth 進行身分驗證,我們不另行建立帳號密碼。你的登入即以你的 Discord 帳號為基礎。
2. 你應對透過你的帳號所進行之一切活動負責,並妥善保管你的 Discord 帳號安全。
3. 若你發現帳號遭未經授權使用,應立即透過 Discord 採取保護措施並通知我們。

6. 使用者內容與授權

1. 你對你所提供之使用者內容負責,並保證你有權提供該等內容。
2. 為了向你及你所屬團隊提供服務(例如顯示你的角色名稱、彙整出席統計、於團隊內共享場次資訊),你授予我們一項非專屬、無償、於提供本服務之必要範圍內使用、儲存、重製及顯示該等使用者內容之權利。此授權僅為營運本服務之目的,我們不會將其用於廣告或販售。
3. 你所設定之角色名稱等公開識別資訊,會在你所加入之團隊內對其他成員顯示(詳見隱私權政策)。請勿填入具冒犯性、侵權或違法之內容。

7. 團隊與團隊管理者之責任

1. 團隊管理者(隊長)可於其團隊內管理成員、場次與相關設定,並可能檢視成員於該團隊之出席資料。
2. 若你身為團隊管理者,你同意僅為經營該團隊之目的合理使用其他成員之資料,不得對外揭露、散布或作其他目的之利用,並自行遵守適用之個人資料保護法令。
3. 我們提供的是工具,團隊內部之管理行為與成員間之爭議,原則上由該團隊自行負責。

8. 使用者行為規範

使用本服務時,你不得:

1. 違反任何適用之法律法規,或侵害他人權利(含智慧財產權、隱私權、名譽權)。
2. 上傳或散布違法、騷擾、仇恨、猥褻、詐騙或惡意之內容。
3. 未經授權存取他人帳號、團隊或資料。
4. 以自動化程式、爬蟲或其他方式對本服務進行不當之大量請求,或試圖干擾、破壞服務之正常運作或安全機制。
5. 對本服務進行逆向工程、破解或規避存取控制(法律明文允許者除外)。
6. 假冒他人或不實表述你與任何人、團隊之關係。

9. 服務之變更、中斷與終止

1. 本服務為個人維運之專案,我們得隨時新增、修改、暫停或終止本服務之全部或部分功能,且不以事先個別通知為必要。
2. 因維護、升級、第三方服務(如 Discord、Cloudflare、代管環境)異常或不可抗力等因素,服務可能暫時無法使用,我們對此不負責任。
3. 若本服務永久停止,我們將盡合理努力以適當方式(如網站公告)事先告知。

10. 帳號停權與刪除

1. 若你違反本條款,我們得於必要範圍內限制、暫停(停權)或終止你使用本服務之權利,並得移除相關內容。
2. 你可隨時停止使用本服務。如欲刪除你的資料,請依隱私權政策之方式與我們聯繫。

11. 智慧財產權與非官方聲明

1. 本服務之程式、介面設計與品牌(「光之點名簿」)之相關權利,除另有標示外,屬我們或授權人所有。
2. 本服務為非官方之玩家自製工具,與 Square Enix 及《Final Fantasy XIV》無任何附屬、贊助或背書關係。 FFXIV 及其相關名稱、標誌、素材之權利均屬 Square Enix 所有。
3. 本服務與 Discord Inc. 亦無任何附屬或背書關係。 Discord 為 Discord Inc. 之商標。

12. 免責聲明

在法律允許之最大範圍內,本服務依「現況」及「現有」基礎提供,我們不提供任何明示或默示之擔保,包括但不限於適售性、特定目的之適用性、正確性、不中斷或無錯誤之擔保。你使用本服務之風險由你自行承擔。

13. 責任限制

在法律允許之最大範圍內,對於因使用或無法使用本服務所生之任何間接、附隨、特別、衍生或懲罰性損害(包括資料遺失、出席資訊錯誤導致之揪團爭議等),我們不負賠償責任。若依法我們仍應負責,其總額以你就本服務所支付之金額為限(本服務為免費,故通常為零)。

14. 第三方服務

本服務之運作仰賴第三方服務(例如 Discord 登入、Cloudflare 之 CDN／安全防護)。該等第三方有其各自之服務條款與隱私政策,我們對其行為不負責任。

15. 條款之修改

我們得隨時修改本條款。修改後將於本頁更新「最後更新」日期並以適當方式公告。修改後你若繼續使用本服務,即視為同意修改後之條款。

16. 準據法與管轄法院

本條款之解釋與適用,以中華民國(台灣)法律為準據法。因本條款所生之爭議,雙方同意以台灣台北地方法院為第一審管轄法院(惟不影響消費者依法得主張之權利)。

1. Acceptance of these Terms

Welcome to "光之點名簿" (the "Service"), developed and operated by Mesker @ 鳳凰("we", "us", or "our"), available at https://xivrc.com.

By logging in to, accessing, or otherwise using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (the "Terms") and by our Privacy Policy in their entirety. If you do not agree with any part of these Terms, please do not use the Service.

2. Definitions

• User: an individual who logs in to and uses the Service.
• Team: a static party / group unit created or joined by a User within the Service.
• Team Manager (Leader): a User with management privileges within a specific Team.
• Platform Administrator: a person with site-wide administrative privileges (designated by the operator).
• User Content: data provided or generated by a User within the Service, such as character name, world, attendance responses, and scheduling information.

3. Description of the Service

The Service is an attendance and session-management tool designed for static parties of Final Fantasy XIV ("FFXIV") players. Its features include, without limitation: creating Teams, scheduling sessions, voting/reporting attendance status (attending / not attending / undecided), and viewing formation status and attendance statistics.

The Service is a free, personal project provided on an "as-is" basis. We do not warrant that its features will exist permanently, be uninterrupted, or be entirely free of errors (see Section 12).

4. Eligibility

To use the Service, you must:

1. Be at least 13 years of age (or the minimum age required to use Discord in your jurisdiction, whichever is higher). If you are below the age of legal majority, you must use the Service under the supervision of a legal guardian.
2. Hold a valid Discord account and comply with the Discord Terms of Service.
3. Comply with Square Enix's applicable terms of use for FFXIV.

5. Account and Login

1. The Service authenticates solely through Discord OAuth; we do not create separate usernames or passwords. Your login is based on your Discord account.
2. You are responsible for all activity conducted through your account and for keeping your Discord account secure.
3. If you discover unauthorised use of your account, you should immediately take protective measures through Discord and notify us.

6. User Content and Licence

1. You are responsible for the User Content you provide and warrant that you have the right to provide it.
2. In order to provide the Service to you and your Teams (for example, displaying your character name, aggregating attendance statistics, and sharing session information within a Team), you grant us a non-exclusive, royalty-free licence, to the extent necessary to operate the Service, to use, store, reproduce, and display such User Content. This licence exists solely for the purpose of operating the Service; we do not use it for advertising or sale.
3. Public identifiers you set, such as your character name, are displayed to other members within the Teams you join (see the Privacy Policy). Do not enter content that is offensive, infringing, or unlawful.

7. Teams and Team Manager Responsibilities

1. A Team Manager (Leader) may manage members, sessions, and related settings within their Team, and may be able to view members' attendance data for that Team.
2. If you are a Team Manager, you agree to use other members' data only for the purpose of operating that Team in a reasonable manner, not to disclose, distribute, or use it for any other purpose, and to comply with applicable personal-data-protection laws yourself.
3. We provide a tool; management conduct within a Team and disputes among members are, in principle, the responsibility of that Team.

8. Acceptable Use

When using the Service, you must not:

1. Violate any applicable law or regulation, or infringe the rights of others (including intellectual-property, privacy, or reputation rights).
2. Upload or distribute content that is unlawful, harassing, hateful, obscene, fraudulent, or malicious.
3. Access another person's account, Team, or data without authorisation.
4. Use automated programs, crawlers, or other means to make improper bulk requests to the Service, or attempt to interfere with, disrupt, or compromise the normal operation or security mechanisms of the Service.
5. Reverse-engineer, crack, or circumvent access controls of the Service (except as expressly permitted by law).
6. Impersonate any person or misrepresent your affiliation with any person or Team.

9. Changes, Suspension, and Termination of the Service

1. The Service is a personally maintained project; we may add, modify, suspend, or terminate all or part of the Service at any time, without any requirement of prior individual notice.
2. The Service may be temporarily unavailable due to maintenance, upgrades, malfunction of third-party services (such as Discord, Cloudflare, or the hosting environment), or force majeure, for which we bear no liability.
3. If the Service is permanently discontinued, we will make reasonable efforts to give prior notice through appropriate means (such as a notice on the website).

10. Account Suspension and Deletion

1. If you violate these Terms, we may restrict, suspend, or terminate your right to use the Service to the extent necessary, and may remove related content.
2. You may stop using the Service at any time. If you wish to delete your data, please contact us as set out in the Privacy Policy.

11. Intellectual Property and Non-Affiliation Notice

1. Rights in the Service's software, interface design, and brand ("光之點名簿"), except where otherwise indicated, belong to us or our licensors.
2. The Service is an unofficial, player-made tool and has no affiliation, sponsorship, or endorsement relationship with Square Enix or Final Fantasy XIV. All rights in FFXIV and its related names, logos, and assets belong to Square Enix.
3. The Service likewise has no affiliation or endorsement relationship with Discord Inc. Discord is a trademark of Discord Inc.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided on an "as-is" and "as-available" basis, and we make no warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, uninterrupted operation, or freedom from error. You use the Service at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, or disputes over party formation caused by incorrect attendance information) arising out of your use of or inability to use the Service. Where we are nevertheless liable under the law, our total liability shall be limited to the amount you have paid for the Service (the Service being free, this is generally zero).

14. Third-Party Services

Operation of the Service relies on third-party services (for example, Discord login and Cloudflare's CDN / security protection). Such third parties have their own terms of service and privacy policies, and we are not responsible for their conduct.

15. Amendments to these Terms

We may amend these Terms at any time. Amendments will be reflected by updating the "Last updated" date on this page and announced through appropriate means. Your continued use of the Service after an amendment constitutes acceptance of the amended Terms.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of China (Taiwan). For any dispute arising out of these Terms, the parties agree that the Taiwan Taipei District Court shall be the court of first instance (without prejudice to any rights a consumer may assert under the law).
